General Terms and Conditions Online Shop

  1. Introduction

These general terms of conditions ("Terms and Conditions") are legally binding and apply to your access to and use of the Online Shop provided by Brussels Airport Company NV/SA.

By using the Online Shop, you acknowledge the contents of these Terms and Conditions and accept them unconditionally. You also accept the documents referenced herein, including the Online Services Privacy Statement.

  1. Company information

These Terms and Conditions have been drawn up by Brussels Airport Company NV/SA, with its registered office at Topos Merode, Priester Cuypersstraat 3 Rue Abbé Cuypers, 1040 Brussels, Belgium and with its place of business at Brussels National Airport 1M, Compass Building, 1930 Zaventem, Belgium, company number 0890.082.292 (RPR/RPM Brussels) (hereinafter referred to as “BAC” or “we”).

  1. Definitions

"Airport Identification Badge":  the identification badge issued by BAC according to the Airport ID Regulations published in the Brussels Airport Handbook (BHB) to persons working at the Airport. These Airport Identification Badges are issued for identification and security purposes and have either a temporary validity period ("Visitor Badges") or are granted to persons working on a regular basis at the Airport for a maximum period of 5 years ("Permanent Airport Identification Badges")

"Airport":  Brussels Airport (IATA airport code: BRU)

"BAC" or "we": Brussels Airport Company NV/SA, as identified in Article 2

"Cookie Policy":  the policy on the use of cookies in the context of the Online Shop, available there

"Coupon Code":  a code redeemable in the Online Shop to receive discounts on certain Products under certain conditions, created by BAC and issued by BAC or a partner of BAC

"Customer Service":  the BAC customer service, the contact details of which are given in Article 18

"Enjoy!": the BAC experience program giving access to specific offers, promotions and advantages, available at https://enjoy.brusselsairport.be

"Online Services Privacy Statement":  the privacy statement on the processing of personal data in the context of the Online Shop, available on the Online Shop

"Online Shop":  the online commercial platform offered by BAC for the sale of goods and services, available at https://shop.brusselsairport.be/   

"Order":  an order for a Product submitted by the User via the Online Shop and accepted by means of an order confirmation

"Product":  a good or service offered for sale by a Seller through the Online Shop

"Seller":  the legal entity selling Products through the Online Shop, being BAC or a third party

"Terms of Sale":  a Seller's terms and conditions governing the sale of a Product as available on the Online Shop

"Terms and Conditions":  the present general terms and conditions governing the use of the Online Shop

"User" or "you":  a person who visits or uses the Online Shop

  1. Introduction to the Online Shop and the role of BAC

The Online Shop is an online trading platform provided by BAC on which you can purchase Products from various Sellers.

The Online Shop clearly indicates who is the Seller of a particular Product. Sellers are always legal entities. No sales by consumers are possible on the Online Shop.

When you purchase a Product from a third-party Seller, the sales agreement is concluded directly and exclusively between this Seller and yourself. BAC merely acts as a platform operator of the Online Shop and thus does not intervene in this relationship, nor does it bear any responsibility for it. This sales agreement is exclusively governed by the Terms of Sale of the relevant Seller, as made available on the Online Shop.

When you purchase a Product from BAC as a Seller, you are entering into a sales agreement with BAC. This sales agreement is governed by BAC's applicable Terms of Sale, as made available on the Online Shop.

  1. Information

The information found on or through the Online Shop is of a general nature. This information is not adapted to personal needs of the User or specific circumstances. BAC reserves the right to modify the information on the Online Shop at any time and at its own discretion.

We do our best to ensure that the information displayed is as complete, correct, accurate and up to date as possible, but are mostly dependent on the information supplied by the Sellers (e.g. on stock). BAC is not liable for any damages resulting from the use of this information. Should displayed information contain errors or should information, which you would normally expect to find on the Online Shop, be missing, we ask you to pass this on to our Customer Service and we will, if reasonable and possible, take the necessary steps to rectify it.

  1. Content provided by third parties

The Online Shop may contain content provided by third parties (e.g., via banners), such as offers, advertising, information and links to websites.

This third-party content is posted on the Online Shop solely for the information of the User. BAC does not make any guarantee about the content, quality or completeness thereof and therefore cannot be held liable for it. You should contact this third party and consult the applicable terms and conditions of this third party if you have any questions or complaints about it.

  1. Restrictions

Some (types of) Products may be subject to certain restrictions, as stated on the Online Shop and/or in the Terms of Sale. Sellers have the right to refuse any Order that would violate such restrictions, which may change from time to time.

In any case, you may not:

  1. buy more than 10 Products in the category "alcohol", regardless of the number of Sellers you bought those Products from;
  2. supply Products in the "alcohol" category to persons under 18 years of age;
  3. buy more than 12 Products in the category "perfumes and cosmetics", irrespective of the number of Sellers from whom you purchased these Products;
  4. buy Products with the intention of reselling them. Products on the Online Shop are intended to be purchased in household quantities and for private purposes; and
  5. buy Products at a discount as a Permanent Airport Identification Badge holder for more than EUR 5,000 per calendar year (offline and online purchase combined).

Certain customs and airline restrictions may also apply when you purchase Products as part of your journey to or from the Airport. You should make your own enquiries before purchasing. The Sellers are not responsible for this.

  1. Recommender system

When you perform a search through the search bar on the Online Shop, the Products are ranked by default by "relevance." However, you can also choose to have the search results ranked differently, i.e., by “popularity”, by “price” or by “brand”.

When you perform a search by using the drop-down menu on the Online Shop, the Products are ranked by “popularity” by default. However, you can also choose to have the results ranked by “price” or by "brand."

When ranking by “relevance”, the relevance score is determined based on the information known about the Products, such as the title and properties. In this way, a Product may match your search query to a greater or lesser extent.

When ranking by “popularity”, the popularity score is determined based on customer interaction data, namely the number of sales and views of a given Product, as well as how recently this Product has been part of the offer.

The parameters of this recommender system are not combined with one another.[SL1] 

  1. Price and payment

The purchase price for a Product is the one indicated on the Online Shop when you validate your Order and given in the order confirmation.

The price is indicated in euros (€) and includes VAT.

However, if you travel to a destination located outside the European Union and indicate this in the Online Shop, then no VAT is due, and the price is reduced by the amount of VAT (" duty free").

When you travel to a European Union member state, taxes and duties are included in the price. When you travel to a destination located outside the European Union, import taxes may apply in the destination country. These import taxes are not indicated on the Online Shop.

The price indicated applies only during the period when this is maintained. The Sellers are entitled to modify the price of a Product at any time. This shall not, however, affect purchases already made. Promotions or discounts are valid only during the period indicated and under the terms and conditions set.

The possible means of payment are displayed during the purchase process. The payment of your Order shall be processed by an external payment services provider and is subject to the general terms and conditions of the payment services provider.

By selecting a payment method and making payment, you confirm your final Order. The purchase is finalized after you receive a confirmation email from BAC.

  1. Use of Coupon Codes[SL2] 

If you have made a purchase through the Online Shop, you may receive a Coupon Code in the confirmation email for a subsequent purchase. You may also obtain a Coupon Code by other means from BAC or one of its partners (e.g., as part of a specific promotion).

You may use a Coupon Code to obtain a discount on specified Products. In addition to the specific conditions mentioned in the statement which includes the Coupon Code, the following conditions apply:

  1. Coupon Codes may only be used by passengers at the Airport, and not by Airport Identification Badge holders (unless specified otherwise);
  2. you may only use Coupon Codes validly issued by BAC;
  3. the value of the Coupon Code and the minimum amount, if any, that you must spend in the Online Shop to take advantage of it will be mentioned in the statement in which the Coupon Code is included;
  4. the duration and expiration date of an offer can be found in the statement in which the Coupon Code is included. Each Coupon Code is valid for a certain period, after this period the Coupon Code can no longer be used;
  5. Coupon Codes cannot be redeemed for cash;
  6. you can only use one Coupon Code per account and per Order;
  7. you cannot combine a Coupon Code with other promotions, actions or discounts;
  8. Coupon codes are for personal use only: you may not share them with third parties;
  9. offers are valid while supplies last;
  10. if a Coupon Code is used for Products of which the (total) price is below the value of the Coupon Code, the remaining value of the Coupon Code is forfeited;
  11. if you return Products for which you have used the Coupon Code, the discount will be forfeited;
  12. Coupon Codes are issued once. In case of theft or loss (such as deletion of emails), no refund will be made;
  13. you may not modify or falsify Coupon Codes (including hacking, spreading viruses and spamming);
  14. you may not use Coupon Codes for commercial purposes and/or purposes other than those for which they were issued.

  1. Delivery

Products are delivered according to the delivery method displayed on the Online Shop. These Products are delivered by the relevant Seller in accordance with its Terms of Sale.

Upon receiving your Order, you must immediately check that the Products delivered correspond to the Products ordered, without opening the sealed plastic bag containing the Products (if applicable due to customs and security regulations). If the delivered Products do not match your Order or if a Product is missing, you must immediately report it to a staff member at the pickup point and file a complaint with the Seller in accordance with its Terms of Sale.

  1. Claims

Any claim relating to the purchase and use of Products (such as withdrawal requests, refunds, claims for hidden defects) must be brought exclusively against the relevant Seller and in accordance with its Terms of Sale. Unless such claim relates to a Product offered by BAC, BAC bears no liability for such claims.

  1. Obligations of the User

By placing an Order, you warrant that you are at least 18 years of age and possess a valid Airport Identification Badge or boarding pass for departure from or arrival at the Airport on the date specified during the purchase process.

You are responsible for providing correct information, such as identity, payment, and contact information.

You can complete the purchase as a guest, or you can register or log in as an Enjoy! member. The purchase of some products requires an Enjoy! membership, as stated in the applicable Terms of Sale. When registering as an Enjoy! member, you should choose a sufficiently original password that is not obviously linked to your name or personal characteristics. You must ensure that identification information is kept secret and that unauthorized persons cannot place orders using your devices and/or identification information. Any Order placed through your account will be deemed to have been placed by you. Any use of Products or other benefits through your account is deemed to have been made by you. If you suspect that your identification information is no longer secure, you should notify Customer Service immediately. If BAC suspects that your account is misused or insecure, BAC may require you to change your password or take other appropriate action.

You agree not to use the Online Shop:

  1. in an unlawful or illegal manner;
  2. in a way that damages, alters, interrupts it or makes it less efficient;
  3. for transmitting or publishing computer viruses, illegal or unlawful material, or material that is in any way inappropriate (e.g., of a defamatory, obscene or threatening nature);
  4. in a way that infringes on the rights of a third party, such as rights of privacy or intellectual property;
  5. for the transfer or publication of material for promotional or advertising purposes.

BAC can take all available judicial and extrajudicial measures necessary to enforce compliance of the present Terms and Conditions for the Online Shop, including the suspension of its services.  BAC may, after issuing a prior warning, suspend the provision of its services for Users who frequently provide manifestly illegal content on the Online Shop. BAC may also, after issuing a prior warning, suspend the processing of notices and complaints regarding illegal content by Users that frequently submit notices or complaints that are manifestly unfounded. BAC suspends the User for a reasonable period of time, as communicated in the decision.

BAC shall consider all relevant facts and circumstances apparent from the available information to decide on the suspension, including but not limited to the gravity of the misuse (e.g. nature and consequences), absolute and relative number of items of unfounded notices or complaints, the relevant timeframe, and the User’s intention insofar relevant.

  1. Right of withdrawal

If you purchase Products as a consumer, you may have a right of withdrawal. This means that you may withdraw from the purchase of a Product, without having to give reasons and without incurring additional costs for a period of 14 days as of the day after the conclusion of the contract (for services) or the day after delivery of the good (for goods).

Please refer to the Terms of Sale applicable to the Product in question for further information on the exercise (or exclusion) of this right of withdrawal.

  1. Guarantee and liability

BAC strives to make the Online Shop available in a safe and functioning manner but cannot guarantee that it will always be available or error-free. You should make use of the Online Shop in due time for every planned journey. BAC reserves the right to refuse access to the Online Shop temporarily or permanently and is not obliged to justify such a refusal.

The Online Shop is provided to you on an "as is" and "as available" basis and you use it at your own risk. To the fullest extent permitted by applicable law, BAC excludes all warranties, express or implied, such as warranties of merchantability, fitness for a particular purpose and non-infringement.

Except for the Products offered by BAC itself, BAC does not exercise control over the information provided by other Sellers on the Online Shop. Accordingly, BAC is not responsible for the suitability, reliability, usefulness and/or accuracy of (i) the information provided by these Sellers and (ii) the Products offered by these Sellers, and related illustrations and other elements contained in the Online Shop. The Products and related information on the Online Shop may contain technical and content inaccuracies or typographical errors. Some hyperlinks on the Online Shop direct you to external websites that are not under the control of BAC. BAC is not responsible for the content of third-party sites.

With the exception of proven intentional or gross misconduct and insofar is permitted by applicable law, BAC cannot be held liable for any damage arising from the use of the Online Shop or from the information contained therein or accessible via the Online Shop (including via available links). Nor can BAC be held liable for damages resulting from technical shortcomings, interruptions of access to the Online Shop or possible harmful interferences with the User's system or software. BAC cannot be held liable for damages caused by possible viruses, bugs, Trojan horses, etc. if these should occur on the Online Shop despite the precautions taken.

Notwithstanding the above, the total liability of BAC shall under all circumstances be limited to the total amount of Products purchased by you during the month in which the incident occurs.

You will indemnify and hold BAC and, if applicable, third-party Sellers harmless from and against any claim, including reasonable legal fees, brought by a third party because of or as a result of your breach of these Terms and Conditions or your violation of any law or the rights of a third party.

  1. Intellectual property rights

Without BAC's prior written consent, it is strictly prohibited to copy, edit, access web pages, apps, software codes, access codes and QR codes or any other content or form elements within the framework of the Online Shop (such as texts, images, data, databases, trade or domain names, trademarks, logos, ...) through digital or automated tools such as hacking, crawling, scraping or use of robots. Nor is it allowed to connect these elements with software applications or hyperlinks, or to use them in any way other than for ordering Products or normal use of the Online Shop. Said elements are protected by intellectual property rights of BAC or its licensors.

If you would have the opportunity to publish your own contributions or images on the Online Shop, you must have the necessary rights to do so yourself. You then grant BAC the right to use these contributions or images for the purposes of the Online Shop, without any compensation. In any case, you completely indemnify BAC against claims of third parties.

  1. Force majeure

BAC shall not be liable if it is unable to fulfil the contract as a consequence of an event that cannot be foreseen and that is not the result of an error or the will of BAC ("force majeure").

Examples of force majeure include war, insurrection, rioting, terrorism, pandemic, strikes or social conflicts, imperative government measures, and immediate termination by a supplier of the cooperation between BAC and this supplier, without this termination being the consequence of a material failure in the part of BAC.

In the event of force majeure, BAC shall ensure that it fulfills its obligations as well and as quickly as possible. This contract shall be terminated automatically, without liability and with immediate effect, if the case of force majeure definitively impedes the fulfilment of the contract.

In case of questions or complaints regarding Products offered by third party Sellers, you may contact the Seller concerned directly according to the procedure mentioned in its Terms of Sale.

Individuals and entities have the opportunity to submit notices about information they consider to be illegal content on the Online Shop. This can be done by sending an email to dsa@brusselsairport.be. Your notice has to be sufficiently precise and substantiated, and contain at least the following elements:

  1. a sufficiently substantiated explanation of the reasons why you allege the information in question is illegal content;
  2. a clear indication of the exact electronic location of that information (e.g. the exact URL(s)) and, where necessary, additional information enabling the identification of the illegal content adapted to the type of content and to the specific type of service;
  3. your name and email address, except in the case of information considered to involve a criminal offence involving sexual abuse, sexual exploitation, child pornography, contacting children for sexual purposes or inciting, aiding or abetting or attempting to commit such offences; and
  4. a statement confirming that the information and allegations contained therein are accurate and complete.

Our Customer Service will inform you without undue delay of our reasoned decision in respect thereof and provide information on your possibilities for redress in respect thereof.

  1. Cookies

The Online Shop makes use of so-called "cookies." These are small pieces of information that we store in your browser or on your computer's hard drive. This allows us to remember your preferences when you use the Online Shop. Through your browser settings, you can change your preferences, reset or block the use of cookies and similar technologies.

  1. Privacy

When you use the Online Shop, BAC may process certain personal data. BAC shall process these personal data exclusively in accordance with the applicable laws on processing of personal data, and in particular the General Data Protection Regulation (GDPR).

If you wish to know more about which personal data are processed and the reasons why BAC collects and processes such data, as well as your rights related to this, please refer to our Online Services Privacy Statement available on the Online Shop.

  1. Final provisions

BAC reserves the right to modify these Terms and Conditions and the content of the service provision at any time. The new Terms and Conditions shall apply to your use of the Online Shop after such modifications. We therefore advise you to save or print a copy of the Terms and Conditions before using the Online Shop. These Terms and Conditions were most recently modified on the date indicated in the header.

Should a provision in the Terms and Conditions or part thereof be declared invalid, unlawful or unenforceable: (i) this shall not in any way affect or impair the validity, lawfulness and enforceability of the remaining Terms and Conditions or the rest of the provision; and (ii) the parties undertake in good faith to negotiate in order to agree on a clause that corresponds as closely as possible to the purpose and the intention of the invalid, unlawful or unenforceable provision or part thereof.

Should BAC refrain from enforcing its rights under these Terms and Conditions, this shall not be considered to be a waiver of this right and shall not under any circumstances extend or modify your rights.

Belgian law applies to these Terms and Conditions. Any dispute relating to these Terms and Conditions that cannot be resolved amicably between the parties or through out-of-court dispute settlement shall fall under the exclusive jurisdiction of the Dutch-speaking courts and tribunals of the legal district of Brussels, without prejudice to the applicable provisions of imperative law relating to consumer contracts. In the event of an international dispute, you may (if you are a consumer) also bring your dispute before the EU Online Dispute Resolution platform via the following link: https://ec.europa.eu/consumers/odr.
